The Supreme Court of NSW has announced the establishment of the Real Property List in the Equity Division of the Supreme Court of NSW commencing on 1 June 2015.
The Real Property List will deal with all matters involving claims in respect of land or interests in land including claims:
- in respect of contracts for the sale of land;
- in respect of leases of land;
- in respect of easements or covenants over land; and
- pursuant to, or in relation to, the provisions relating to the provisions of statutes relating to real property including the Real Property Act 1900 (NSW), the Conveyancing Act 1919 (NSW), the Crown Lands Act 1989 (NSW) and legislation governing the creation and management of strata schemes and community schemes.
The Real Property List will not however include proceedings which would be commenced in the Possession List and the Possession List continues to operate.
